Terms & Conditions

These Terms and Conditions ("Terms") apply to purchases made from Alfresco Emporium (ABN 53 723 284 741) ("Alfresco Emporium", "we", "us", "our"), whether made in one of our stores or through our website. By placing an order with us, whether in-store or online, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced within them.

These Terms apply equally to trade and interior design customers purchasing through our Trade Program.

Eligibility

You must be at least 18 years of age to place an order with Alfresco Emporium, whether in-store or online.

Promotions

• New subscriber: New subscribers receive a 'Welcome' coupon code offering a $10 discount on their first purchase. The code is valid for 30 days from issue and can only be used on a first order. It holds no cash value, is non-transferable, and cannot be combined with other offers. If you've already purchased from us before subscribing, the code does not apply retrospectively.
• Discount codes: Discount codes cannot be applied to gift cards.

Placing an order

When you place an order, whether in-store or online, you are making an offer to purchase the relevant products on these Terms. For online orders, you will receive a confirmation email once your order has been placed. This email confirms receipt of your order and is not acceptance of your offer. Your order is accepted, and a contract formed, once we confirm your order is being processed for dispatch or collection.

We may decline or cancel an order, in whole or in part, at our discretion, including where a product is unavailable, where there is an error in the price or description of a product, or where we reasonably suspect fraud. Where we decline or cancel an order, we will notify you and refund any payment already made.

Stock levels and estimated delivery or arrival dates shown on our website are estimates only and may change without notice.

Pricing and payment

All prices are listed in Australian dollars and include GST unless otherwise stated. Prices are subject to change at any time, and the price applicable to your order is the price displayed at the time your order is accepted.

We accept payment online by Visa, Mastercard, American Express, PayPal, and Afterpay; by phone using Visa or Mastercard; and in-store by cash, Visa, or Mastercard [to confirm: do we still accept cheque in-store?]. Buy-now-pay-later services such as Afterpay and PayPal Pay in 4 are provided by third parties and subject to their own separate terms and conditions, which you should review before use.

Full payment & deposit:

• Full payment is required at the time of purchase for all in-stock products, whether ordered online or in-store. Full payment is also required for online orders where the product is not in stock at the time of purchase. 
• For in-store orders where the product is not in stock at the time of purchase, a deposit of 50% of the order value may be accepted, with the remaining balance payable prior to dispatch or collection.
• Products marked as part of a sale require full payment at the time of purchase, regardless of stock availability. Where a deposit has been accepted on a sale item, the balance must be paid within 7 business days of the first request for payment.

 

Delivery and collection

We deliver across Australia and to select overseas destinations, with some exclusions applying to furniture and bulky items. Estimated delivery timeframes vary by product and location and are estimates only. Click & Collect orders are held for 7 days from the date you are notified they are ready for collection; uncollected orders are returned to stock and a store credit issued for the order value.

Trade accounts

Where you hold a trade account with Alfresco Emporium, your purchases remain subject to these Terms in addition to any separate terms applicable to your trade account. Trade pricing and terms do not affect your obligations, or our rights, under this document.

Gift cards

Alfresco Emporium gift cards can be redeemed online or in-store and are valid for 3 years from the date of purchase, in accordance with Australian legal requirements. Gift cards cannot be redeemed for cash, are not eligible for change-of-mind returns, and any balance remaining after expiry is forfeited.

Change of mind, returns, and refunds

Change-of-mind returns, damaged or faulty items, non-returnable products, and refund and store credit processes are set out in full in our Returns & Refunds policy, which forms part of these Terms.

Nothing in this policy limits your rights under the Australian Consumer Law.

Product warranty

All products are covered by our manufacturing warranty, in addition to your rights under the Australian Consumer Law. Full warranty terms, including coverage period and exclusions, are set out in our Product Manufacturing Warranty policy.

Product information and natural variation

We take reasonable care to ensure product descriptions, images, and pricing on our website are accurate. Colours may vary slightly due to screen settings, lighting, and manufacturing processes, and minor variation is not considered a fault. Many of our products are handcrafted or made from natural materials, and variation in colour, grain, texture, and pattern placement is a normal characteristic of these materials rather than a defect.

Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, restricted, or modified.

Limitation of liability

To the extent permitted by law, Alfresco Emporium is not liable for any indirect, incidental, or consequential loss arising from your use of our website, your purchase, or your use of our products, except as set out under the Australian Consumer Law. Where our liability cannot be excluded but can be limited, we limit it, at our option, to resupplying the relevant products or services, or covering the cost of doing so.

Intellectual property

All content on our website, including text, images, logos, and graphics, is owned by or licensed to Alfresco Emporium and is protected by Australian copyright law. You may view and download content for personal, non-commercial use only. Reproducing, modifying, or distributing our content for any other purpose without our written permission is not permitted.

Privacy

We collect and handle personal information in accordance with our Privacy Policy, which forms part of these Terms.

Force majeure

We are not liable for any delay or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, including natural disasters, extreme weather, industrial action, or disruption to our suppliers or delivery partners.

Governing law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales in relation to any dispute arising from these Terms.

Changes to these Terms

We may update these Terms from time to time. Changes take effect once published on this page. Your continued use of our website or stores, or placement of a further order, after changes are published constitutes acceptance of the updated Terms.
